DMCA Takedown Policy

A note about AAC and fair use. The GoTalk NOW Online Gallery hosts communication templates designed for Augmentative and Alternative Communication (AAC). These templates incorporate images and symbols to enable people with communication disabilities to express basic needs, participate in education, and engage socially.

The use of images within AAC communication boards is generally considered transformative fair use under U.S. copyright law — the original work is repurposed for a fundamentally different communicative and educational function, not to substitute for the original. We ask that potential complainants carefully consider whether the use of material in an AAC template is truly infringing before submitting a takedown notice.

Penalties for false claims. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or that material was removed or disabled by mistake — may be liable for damages, including costs and attorneys’ fees incurred by the alleged infringer, the copyright owner, or the service provider. This is a statutory provision with real consequences, not optional legal boilerplate.

How to Submit a Takedown Notice

If you believe that material hosted on this site infringes your copyright, you may submit a DMCA takedown notice by sending the following information to dmca@attainmentcompany.com:

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the material you believe is infringing, with enough information to locate it (e.g., the template URL).
  3. Your contact information: name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.
  6. Your physical or electronic signature.

Counter-Notice Procedure

If your content was removed and you believe the takedown was issued in error or through misidentification, you may submit a counter-notice to dmca@attainmentcompany.com containing:

  1. Identification of the material that was removed and its location before removal.
  2. A statement, made under penalty of perjury, that you believe the material was removed as a result of mistake or misidentification.
  3. Your name, mailing address, and telephone number.
  4. A statement that you consent to the jurisdiction of the federal district court in your judicial district (or, if you are outside the United States, any judicial district in which the service provider may be found).
  5. Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, the removed content will be restored.

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Attainment Company will terminate access for users who are determined to be repeat infringers of copyright.
